In 1847, aged 23, Thomas was convicted at the Warwickshire Assizes 'for stealing at the parish of Sollhull one sheep, the property of Rev A Clive' (Birmingham Gazette, Mon Apr 5 1847).
Thomas was sentenced to seven years transportation.
Thomas left for Australia aboard ‘Hashemy’, in December 1848. Four year later he married Nancy Whittaker (daughter of John and Eleanor), at Wollongong.
